Privacy Policy

This Privacy Policy applies to the TC logiQ, Inc. website located at www.tclogiq.com, which governs its data collection, usage, and services. This Privacy Policy discloses how we collect, protect, use, and share information gathered about you on our website. This Privacy Policy is effective as of January 1, 2002.

Information Use and Collection


TC logiQ customers are our most valuable asset. Protecting privacy is high priority for TC logiQ. This website only collects personally-identifiable information from you if you chose to provide this information to TC logiQ. TC logiQ do not intentionally collect information from any individuals under the age of 13 years. Personally-identifiable information that is given to us is kept confidential and is not sold in any form.

A "cookie" is a piece of information stored on your computer (i.e. hard drive). Although cookies are used for a variety of purposes, our website does not use cookies. This website also collects non-personally identifiable information. For instance: we may collect information about your visit; monitor statistics such as the number of people that visit our site; which page(s) are visited on our site; from which domain our visitors come (i.e. yahoo.com, aol.com, etc.); and which browser people use to visit our website, but we do not collect any other personal information unless provided by you.

The information collected by this website is used for reasonable purposes such as: for administration purposes; improvement of the website; responding to your inquiries and/or otherwise corresponding with you; processing transaction you request; and maintaining your account providing that you have an account with TC logiQ. In some cases, TC logiQ may contact you in response to your inquiries or comments as part of the maintenance of your account and/or as part of the services provided by TC logiQ.

From time to time, TC logiQ may disclose information you provided to a third party in order to respond to your inquiries and/or complete a transaction that you requested. In some cases, it may be necessary to disclose information you provided about yourself to third parties in order to generate the products and services that you inquired about and/or requested. In such cases, TC logiQ requires that the companies acting on our behalf abide by our Privacy Policy and institute safeguards to protect the confidentiality of your information.

Communications from us when you request something from this website will be sent to you via transactional emails related to your service request. You cannot opt out of receiving these communications. However, you can opt in to receive promotional and newsletter emails from us should we generate this information to you. If you later choose to opt out of receiving these emails, you can unsubscribe by clicking on the link included in the email or logging into your screening account and changing your preferences.

Before we use your personal information for marketing purposes, we will offer you the opportunity to choose whether or not to have your information used for this purpose. Otherwise, we do not share, sell, rent, or trade your personal information with third parties for their promotional purposes. Moreover, we may disclose personal information when required by law or to comply with the legal process or in the good faith belief that such action is necessary in order to conform to the law.

In addition, we maintain your personal information for the life of your screening account with an organization that has a contractual agreement with TC logiQ. Upon termination of the agreement and in accordance with the agreement we will remove your personal information from our databases or unless you request that we remove your personal information from our databases. After termination of the agreement, your personal information will be maintained for 7 years and then, it will be removed unless the agreement stipulates otherwise.

Access and Correction

TC logiQ recognized the importance of accurate data. Consequently, we strive to maintain the accuracy of the information collected from you. We believe that our customers are invaluable in ensuring that data is complete and accurate when supplying TC logiQ with information. We will provide you with access to personally-identifiable information that you provide as long as we maintain that information in a readily accessible format. In contrast, we permit and encourage you to correct, update, and/or delete inaccuracies in the information that you submit to us through our website. If you wish to correct any inaccurate information you have submitted, please email us at customerservice@tclogiq.com. We will respond to your inquiry within 30 days of receiving your request.

Should you dispute the accuracy of your screening results, we follow the guidelines and rules outlined in the Fair Credit Reporting Act (“FCRA”). Consumers have specified rights under the FCRA to obtain personal information that we maintain in their screening accounts and electronic files. Consumers also have specific rights under the FCRA to dispute the accuracy and completeness of personal information in their screening accounts and electronic files. If you are disputing the accuracy of your screening search, an email would have been sent to the registered email on your screening account. However, if you did not receive this correspondence, please send an email to reportdispute@tclogiq.com. In this email, please include your complete name, mailing address, telephone number, email address registered with your screening account, date of birth, and state your reasons for disputing the accuracy of the screening results. We will respond to yours request either via email or telephone within 30 days. After we perform research on your request and if we discover that information is incorrect, we will update our databases and change the report, which would be available for your review upon your request via email. If we are correct in our reporting, then, the screening results will remain the same and you will be notified via email of this information.

You Can Opt Out of TC logiQ Maintaining Your Personal Information

If you are interested in getting your personal information removed from our database you may send an email to customerservice@tclogiq.com. In your request, you must identify you complete name, mailing address, email address registered with your screening account, date of birth, and state that you would like for your personal information to be removed from our databases. Should TC logiQ remove your personal information from our databases, based on your request, this may affect your membership or participation in an organization that you requested your background screening to be run for with that particular organization.

If TC logiQ or its assets are acquired by another company, that company will assume responsibility for the personal information collected by us through TC logiQ’s website and it will assume the rights and obligations regarding the information collected through this website, as described in this Privacy Policy. Should TC logiQ file bankruptcy, all personal information will be removed and returned to the organization for future screening references.

Security

As a Consumer Reporting Agency (CRA), we actively engaged in ensuring our systems and data are highly secured. We have taken many steps to protect against the loss, misuse, or unauthorized alteration of personally-identifiable information collected through TC logiQ’s website. We exercise extreme caution and care in providing secured transmission of your information from your PC to our servers.

In the event we request or transmit sensitive information, such as credit card information or Social Security Numbers, we use industry standard, secure socket layer ("SSL") encryption. This consists of several layers of firewalls, trap doors, encrypted files systems and extensive logging that provide robust protection. Further, we strictly limit access to personally-identifiable information to those employees who need access in order to carry out their job responsibilities.

Safe Harbor

In accordance with our commitment to protect personal privacy, TC logiQ adheres to the principles of the Safe Harbor Framework as developed by the U.S. Department of Commerce in consultation with the European Commission. Arbitration

Any controversy or claim arising out of or relating to this Privacy Policy or the breach hereof, which cannot be settled by the good faith efforts of the parties to resolve the matter, shall be settled by binding arbitration in Colorado Springs, CO, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (the “AAA”) by a single arbitrator, who will be eTrust Privacy Services, if the parties cannot jointly select an arbitrator, and judgment upon the award rendered may be entered in any court having jurisdiction thereof.

Policy Changes

We may revise this online Privacy Policy from time to time so that we may continue to improve TC logiQ's products and services. If we make any material changes, we will notify you by posting a prominent announcement on the website and in the customer’s interface.
